Annual Leave Payment

The Annual Leave Law of 1951 stipulates that every employer is obligated to send the employee on annual leave, in order to allow them to rest and return to work with renewed strength. This is a peremptory law that is binding and prohibits contracting out of it, meaning the employer can add leave days but cannot subtract from the minimum stipulated in protective labor laws. The calculation of leave days to which every employee is entitled is done according to seniority at the workplace, collective agreements and/or extension orders based on the employment sector, and the individual employment contract. Generally, the more senior the employee is, the more leave days they will be entitled to. An employee with 1-4 years of seniority who works 6 days a week is entitled to 16 gross annual leave days, including weekends. An employee with 7 years of seniority is entitled to 21 annual leave days.
