Is it realistic to recover a debt from an employer?

I have been working in a private company for more than 3 years. At the time of starting work, I had a pension program opened by the employer at my previous place of employment. However, at the new place, this was not taken into account, and to this day, no contributions to the pension fund have been made. 1. To which court can I apply for the recovery of the entire debt from the employer? 2. Is it realistic to recover this debt? 3. What punitive sanctions against the employer can be considered?

You can apply to the labor dispute court at your place of residence. Your employer was obliged to make contributions to the pension fund from the first day of work if there is a collective agreement or a decree of the Ministry of Labor concerning the industry of employment, or in the extreme case, after six months. You have the right to recover from the employer a lump sum in the amount of 6% of the monthly salary multiplied by the number of months worked, or to compel the employer to make contributions to the pension fund retroactively. In any case, penalties and interest will be imposed on the employer for failure to make timely contributions.
